Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Arck ("Arck," "we," "us") governing your use of the Arck website at arck.store, the Arck Chrome extension, and all related services (together, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Arck Is

In plain English: Arck helps you list items for sale on multiple marketplaces at once, notices when something sells, and takes it down everywhere else.

Arck is a cross-platform reselling tool. The Service lets you:

  • Create item listings, with optional AI-assisted photo analysis that drafts titles, descriptions, and item details for you;
  • Publish those listings to third-party marketplaces you connect, including eBay, Depop, Grailed, and Poshmark (“Marketplaces”);
  • Detect sales on those Marketplaces, through each Marketplace's own API or through the Arck Chrome extension reading your own signed-in seller pages; and
  • Automatically remove (“delist”) a sold item from the other Marketplaces.

Arck does not read your email and requests no mail permissions from any provider.

Arck is an independent tool. We are not affiliated with, endorsed by, or partnered with eBay, Depop, Grailed, Poshmark, Google, or any other third party named in the Service.

2. Who Can Use Arck

In plain English: You must be an adult, use your real information, and keep your login to yourself.

To use the Service you must:

  • Be at least 18 years old and able to form a binding contract;
  • Register with accurate information and keep it up to date;
  • Keep your account credentials confidential. You are responsible for all activity under your account. Tell us immediately at lucca.walls@arck.store if you suspect unauthorized access.

You may not share, sell, or transfer your account.

3. Subscriptions, Trials, and Billing

In plain English: 30 days free, then a monthly subscription that renews automatically until you cancel. Cancel anytime; you keep access through the period you paid for.

Free trial. New accounts receive a 30-day free trial with access to the Service. No payment method is required to start a trial. When the trial ends, you must subscribe to continue using paid features.

Plan. Arck has one plan: Reseller, $8.90 per month, with every feature included. Current pricing and plan features are shown in the app at the time of purchase; those control if they differ from this document.

Billing. Subscriptions are billed monthly in advance through our payment processor, Stripe, and renew automatically each period until you cancel. By subscribing, you authorize us and Stripe to charge your payment method on each renewal.

Taxes. Prices are exclusive of any sales, use, VAT, or similar taxes. Where we are required to collect them, they are added at checkout and shown before you confirm.

Cancellation. You can cancel anytime from your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period; you keep access until then. Except where required by law, payments are non-refundable and we do not prorate partial periods.

Failed payments. If a renewal charge fails, we may retry it over a limited period and will notify you at your account email. We may suspend or downgrade your account if payment does not succeed.

Price changes. We may change prices with at least 30 days' notice by email or in-app notice. Changes apply from your next renewal; if you don't agree, cancel before the change takes effect.

4. Connecting Marketplaces: Your Accounts, Your Responsibility

In plain English: Arck operates your marketplace accounts for you, at your direction, using your own logins in your own browser. Each marketplace has its own rules, and staying within them is on you. If a marketplace restricts or bans your account, that is a risk you accept by using an automation tool.

You authorize us to act on your behalf. When you connect a Marketplace account, you instruct and authorize the Service, including the Arck Chrome extension running in your browser, to access that account and take actions for you: creating and publishing listings, editing them, detecting sales, and delisting sold items. These actions are performed using your own credentials and sessions, from your own device, at your direction.

You are responsible for Marketplace compliance. Each Marketplace has its own terms of service, seller policies, and rules, which may restrict automated or third-party tools. You are solely responsible for reviewing and complying with the terms of every Marketplace you connect. You accept the risk that a Marketplace may throttle, suspend, restrict, or terminate your account as a result of activity performed through the Service, and you agree that Arck is not liable for those consequences.

Some of the Service needs your browser open. Several Marketplaces have no usable publishing or delisting API, so Arck performs that work through the Chrome extension in your own signed-in browser session. Those actions run when your browser is open and the extension is installed and signed in, not on a server. Delisting and publishing on those Marketplaces can therefore be delayed, and Arck does not promise that any action completes within a particular time.

Marketplaces change without notice. Marketplaces regularly change their websites and systems in ways that can break or degrade the Service's features for that platform. We work to keep integrations functioning but do not guarantee that any specific Marketplace integration will work at any given time.

Your transactions are yours. Arck is not a party to any sale between you and a buyer. Payments, shipping, returns, buyer disputes, taxes, and fees on each Marketplace are entirely between you, the buyer, and that Marketplace.

5. AI-Assisted Listings: Review Before You Publish

In plain English: The AI drafts your listing from photos. It is usually right, but not always. It is a draft. You are the seller of record, and checking the listing before it goes live is your job.

The Service uses artificial intelligence to analyze your item photos and suggest listing details (title, brand, size, condition, description, price, and similar fields). AI output is a suggestion, not a fact. It may be incomplete, inaccurate, or wrong.

You are responsible for reviewing and correcting every listing before it is published. The accuracy of published listings, including brand names, item condition, authenticity claims, and pricing, is your responsibility as the seller, not Arck's.

6. Your Content and Our License to It

In plain English: Your photos and listings stay yours. You give us permission to store and process them and send them to the marketplaces you choose. That permission is what lets the product work.

You retain all ownership rights in the photos, descriptions, and other content you upload (“Your Content”). You grant Arck a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, process (including with AI), and transmit Your Content solely to operate, provide, and improve the Service: for example, storing your photos, generating listing drafts, and publishing your listings to the Marketplaces you select.

This license ends when you delete the content or your account, except for copies already published to Marketplaces at your direction and copies in routine backups (which are purged on a rolling basis).

You represent that you own or have the rights to Your Content and that it does not infringe anyone else's rights.

7. Acceptable Use

In plain English: Sell real, legal stuff. Do not abuse the tool, do not hack it, do not use it to break the law or a marketplace's rules on prohibited items.

You agree not to use the Service to:

  • List or sell counterfeit, stolen, illegal, or recalled items, or items prohibited by an applicable Marketplace;
  • Mislead buyers, including through false condition, authenticity, or brand claims;
  • Violate any law or third-party right;
  • Probe, disrupt, overload, reverse engineer, or attempt to gain unauthorized access to the Service or its systems;
  • Resell, sublicense, or provide the Service to third parties, or use it to build a competing service;
  • Circumvent usage limits, trial restrictions, or billing.

We may suspend or terminate accounts that violate this section.

8. Credentials and Security

In plain English: Tokens we store for you are encrypted. But no system is unbreakable, and you should protect your own devices too.

Marketplace tokens the Service stores are encrypted at rest. We take commercially reasonable measures to protect your data, but no method of transmission or storage is 100% secure, and we cannot guarantee absolute security. You are responsible for the security of your own devices, browser, and marketplace passwords. Our handling of personal data is described in our Privacy Policy at arck.store/privacy, which is part of these Terms.

9. Our Intellectual Property

The Service, including its software, extension, design, and branding, is owned by Arck and its licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own reselling business while you have an active account. We reserve all rights not expressly granted.

10. Termination

In plain English: You can leave anytime. We can close accounts that break the rules or do not pay. If the account closes, your data is deleted after a wind-down period.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access (with notice where practicable) if you breach these Terms, if your subscription lapses, or if we discontinue the Service.

Upon termination, your license to use the Service ends. We may delete Your Content after a wind-down period of 30 days; export anything you need before then. Sections that by their nature should survive (including Section 6's representation and Sections 11 through 14) survive termination.

11. Disclaimers

In plain English: We work hard to make Arck reliable, but it is provided as is. We cannot promise it will always work, that marketplaces will not change under it, or that the AI is always right.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; ANY MARKETPLACE INTEGRATION WILL FUNCTION AT ANY GIVEN TIME; SALES WILL BE DETECTED, OR LISTINGS PUBLISHED OR DELISTED, ACCURATELY OR ON TIME; OR THAT AI-GENERATED CONTENT WILL BE ACCURATE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of Liability

In plain English: If something goes wrong, the most we owe you is what you paid us in the last 12 months. We are not on the hook for lost sales, banned marketplace accounts, or other indirect fallout.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) ARCK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, LOST DATA, OR MARKETPLACE ACCOUNT SUSPENSION OR TERMINATION, ARISING FROM OR RELATED TO THE SERVICE; AND (B) ARCK'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (ii) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

In plain English: If your items, your listings, or your rule-breaking gets us sued, you cover the cost.

You agree to defend, indemnify, and hold harmless Arck from any claims, damages, and expenses (including reasonable attorneys' fees) arising from: (a) Your Content or the items you list or sell; (b) your violation of these Terms, any law, or any Marketplace's terms; or (c) your dealings with buyers or Marketplaces.

14. Governing Law and Disputes

In plain English: We both agree to talk before suing.

Before filing any claim, you agree to contact us at lucca.walls@arck.store and give us 30 days to work it out informally.

15. Changes to These Terms

We may update these Terms from time to time. For material changes, we will give notice by email or in-app at least 14 days before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms; if you don't agree, stop using the Service and cancel your subscription.

16. Miscellaneous

These Terms (plus the Privacy Policy) are the entire agreement between you and Arck regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be sent to your account email.
